1. Plain-English summary
You can use our apps for your own learning, or your family's, or your class's. The free parts are free. Premium is a single one-off purchase made through Apple or Google, with no subscription and no adverts. Anything you type or record in an app stays on your device and belongs to you. We'll do our best to keep the apps working well, but we can't promise a particular exam result. Nothing here takes away the rights you have as a consumer under UK law.
The detail below is what that means precisely. If anything is unclear, write to us at hello@memoleap.com.
2. Who we are and what these terms cover
MemoLeap is a brand of educational mobile applications made by Building on It Limited, a company registered in England and Wales (company number 5305718). Our registered office is at Apt 1008, 222 Marsh Wall, London, E14 9EN. Our trading address is 37th Floor, One Canada Square, London E14 5AA.
These terms apply to the memoleap.com website and to every MemoLeap app, on every platform. By using the website or installing an app you agree to them. If you don't agree, please don't use the website or the apps.
Our Privacy Policy explains how we handle information. It forms part of these terms.
3. The apps and the app stores
The apps are supplied through Apple's App Store and Google Play. When you download an app or make a purchase, the store's own terms apply alongside ours, and the store processes the transaction.
For apps obtained from the App Store, Apple's Licensed Application End User License Agreement applies unless a different licence is shown on the app's App Store page. Where Apple's agreement and these terms cover the same ground, Apple's agreement takes precedence for that point. Apple is not responsible for the apps or their content, and has no obligation to provide support or maintenance for them; that is our responsibility.
For apps obtained from Google Play, the Google Play Terms of Service apply in the same way.
4. Your licence to use the apps
We grant you a personal, non-exclusive, non-transferable licence to install and use each app on devices you own or control, for your own learning or the learning of people in your care. Teachers and tutors may use the apps with their pupils and students on the same basis.
You may not:
- copy, modify, reverse-engineer, decompile or create derivative works of an app, except where the law allows this regardless of what we say here;
- sell, rent, lend, sub-license or otherwise redistribute an app or any of its content;
- remove or obscure any copyright or other proprietary notice;
- use an app in any way that is unlawful, or that could damage or impair it for other users.
Each app, including its design, software, built-in word groups, audio and other content, is owned by Building on It Limited or our licensors and is protected by copyright and other intellectual property laws. Nothing in these terms transfers ownership to you.
5. Premium unlock and payments
Each app is free to download and includes a free set of content. Some content and features require Premium, which is a single one-off, non-consumable in-app purchase. There is no subscription, no recurring charge, and no advertising in any version of any app.
The purchase is made through, and processed by, Apple or Google. The price is shown in the store before you buy, in your local currency and including any applicable tax. We never see your payment details.
Premium is tied to the store account you bought it with. If you reinstall the app, or install it on another device signed in to the same store account, use the app's Restore purchases option to reinstate it at no charge.
Refunds for in-app purchases are handled by Apple or Google under their own policies, because they processed the payment. We are not able to issue refunds directly. If you need a refund, please request it through the App Store or Google Play; if you run into difficulty, contact us and we'll help where we can. This does not affect your statutory rights, including your rights under the Consumer Rights Act 2015 if the app is faulty.
6. Children and parents
Our apps are designed to be suitable for children and do not require an account. If you are under 18, a parent or guardian must agree to these terms on your behalf. A parent or guardian who allows a child to use an app is responsible for that use, including any purchase made from the device.
Both stores offer parental controls that can require approval before a purchase is made. We recommend turning them on for any device a child uses.
The specific protections we apply when an app is used by a child are set out in the children's privacy section of our Privacy Policy.
7. Your content and ours
Word lists, recordings, scripts and anything else you create in an app are yours. They are stored on your device and are not uploaded to us. You are responsible for what you create, and for making sure you have the right to use any material you enter (for example, text you type in from a book).
If you delete an app, the content you created in it is deleted with it unless you have backed up your device. We are not able to recover it.
The built-in content we supply remains ours and may be used only within the app, under the licence in section 4.
8. Availability and changes to the apps
We aim to keep the apps working well and to improve them over time. We may update an app, add or change features, and occasionally withdraw an app or a feature. Where a change would remove functionality you have paid for, we will give you reasonable notice and, where appropriate, an alternative.
Updates are delivered through the stores. Some updates may require a newer version of iOS or Android than your device supports; we aim to support current and recent versions but cannot support every device indefinitely.
We do not guarantee that an app or the website will be available at all times or free of errors, but if something is wrong we want to know about it: see section 11.
9. Learning outcomes
Our apps are built around well-established techniques for remembering, and we believe they work. They are a support for learning, not a guarantee of it. We cannot promise any particular result in a test, examination or anything else, and the apps are not a substitute for teaching.
10. Our responsibility to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
If you are a consumer, nothing in these terms affects your legal rights, including your right under the Consumer Rights Act 2015 to digital content that is of satisfactory quality, fit for purpose and as described.
Subject to the two paragraphs above, we are not liable for any loss that was not a foreseeable result of our breaking these terms, for loss of data you have not backed up, or for any loss arising from your use of an app for a business or commercial purpose. Where we are liable to you, our total liability in connection with an app is limited to the amount you paid for Premium in that app, or £10 if you paid nothing.
11. Support and complaints
If something isn't working, or you have a question, the quickest route is our support page, which has guides for each app and a form that reaches us directly. You can also email support@memoleap.com. We aim to reply within three working days.
If you are unhappy with how we have handled something, tell us and we will try to put it right. As a consumer you may also be able to use the alternative dispute resolution or court routes available to you under UK law.
12. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and you keep the benefit of any mandatory consumer protections in the country where you live.
13. Changes to these terms
We may update these terms from time to time, for example when we release a new app or when the law changes. The date at the top of this page shows when they were last updated. For a change that materially affects your rights, we will tell you in the app or on the website before it takes effect. Continuing to use the apps after that date means you accept the updated terms.
